The Digital Economy Bill has been granted on the 8 April 2010 whereby the onus falls on users or more to the point partners in a practice or directors of a business rather than the Internet Service Providers (ISP’s) to ensure that the business broadband connection is not being used illegally.

The bill states that if you or your staff members are found conducting illegal file sharing or illegal downloading of music and films, copyright holders will be able to obtain names and addresses of the offenders through a court order. Action can then be taken which could result in suspension of the business internet connection.

The loss of internet connectivity for any modern business would be catastrophic, no emails, no web, no remote access and support.

This is an added overhead and increases to the risk management that each business faces. Business’s have always known about the risks involved in giving staff access to the internet and the penalties that can face the business partners and directors if any illicit materials are accessed over the internet.

Now not only are those businesses at risk from porn or other illicit material but also from theft of copyright by sharing pictures, music or videos.

The bill passes yet another IT overhead to the practice and each business needs to ensure that their network is secure especially when wireless access points are concerned.

Question by sman: i may loose a chance at a great job due to DPS entering stuff on my backround wrong can i take legal action?
DPS has hired in outside companies to enter in information into databases cancerning backrounds and they are entering in false information and i have proof of it. I can get it fixed but it still cost me a job that pays 00 a week. Can i take legal action against the state for this?

LOSE. You can’t prove that’s why you didn’t get the job. Also, you can’t sue a state in most cases…it’s called Sovereign Immunity…look it up.

Case Management – Beyond Legal Software

Last year DPS Software signed four new clients. Access – DPS Clients proved their mettle by braving the near?Arctic conditions to attend the DPS Software User Meeting on Wednesday 13th January.

Microsoft played host to this year’s meeting at the rather plush surroundings of the London Customer Centre in Victoria, the perfect setting for a technical discussion of the IT landscape for 2010.

Osman Ismail, Managing Director at DPS, opened the meeting with an overview of 2009 and development plans for 2010. He also welcomed Access clients to their first User Meeting.

As the world of technology is constantly changing, it is becoming increasingly difficult for solicitors to keep up. Scott Ridley, Technical Director, discussed the reasons behind why many solicitors are turning to hosted solutions to remove this burden. He also gave clients an insight into the world of Software as a Service, Facilities Management, Virtualisation and Business Continuity.

This year saw us welcome a guest speaker. Sukhi Dhillon, Land Registry Product Manager, HM Land Registry. Sukhi discussed the new Business Gateway which will enable property professionals to conduct preliminary searches and submit the Charge. The Business Gateway will work alongside the existing Portal.

Scott Ridley took to the floor a second time to discuss the LSC changes planned for 2010. Plans for Civil work in 2010 include:
• Civil contracts to be extended until October
• Changes to standard fees f including advocacy
• E?forms rollout in Q1
• Phase 1 of Delivery Transformation

Criminal changes in 2010 include:
• Crime contracts extended until July

An important part of the DPS User Meeting is to give clients the opportunity to discuss problems or issues of direct relevance to themselves as users in a face?to?face environment. To ensure that all delegates were given this opportunity, DPS staff presented at smaller focus groups. These groups covered: Crime, Family, Personal Injury, Probate, Access and Cashier. The day closed with a showcase of all the new products mentioned during the course of the meeting.

The new three phased process of Delivery Transformation for Criminal and Civil Billing as proposed by the LSC is anticipated to have a huge impact on the legal practice –

Delivery Transformation (Criminal & Civil Billing):
Stage 1 – by December 2009 certain CDS and Civil forms will be able to be submitted online via a csv/xml upload. This will provide a basic introduction to the concept of electronic submission.

Stage 2 – Starting from April 2010 (anticipated roll out by October 2010) the LSC will be introducing a secure link to the LSC database, where solicitors will be able to determine whether they are eligible to perform certified work. This facility will also enable Solicitors to undertake 75 & of means testing and 25% of merits testing online with instant decisions.

Stage 3 – By April/May 2011, electronic billing e.g. Claim 1 and payment should be rolled out.

DPS Software have developed an online seminar to guide solicitors through the new process. If solicitors are not prepared for the changes they could see a huge gap in their profits for 2010/2011 and ultimately, they could lose their contracts.

The new DPS Civil Billing module has been adapted to include a data exchange facility which will pass through information from the DPS system to the LSC to prove eligibility for legal aid. The system also includes the facility to scan online directly to an LSC file and offers bulk upload of the consolidated matter report form CMRF and the consolidated matter start form CMSF.

The point is that we all need to make a contribution to saving the planet and if that contribution can also save use money, time, make out lives easier then saving the planet became more attractive all of a sudden!

We won’t be showing any actual video or relaying any of the actual broadcast in any way – basically just doing our own commentary on the game for others to listen. Thanks for your help!
