Across the country, governors have traditionally headed to their respective state houses to reflect on past year’s accomplishments and challenges as well as their plans for the new year.  Texas Governor Rick Perry took his turn at the podium and delivered his State of the State address to the Legislature. As the governor prepares for a tough re-election bid next year, he was determinedly cautious in the proposals he set forth. He did not share many details about the current economic conditions in our state, which received immediate criticism from his Democratic opponents. However, there certainly were some ideas in his speech that should be highlighted for their possible legal impact on the residents of Texas.

Are you reorganizing your personal or business finances as you figure out how to send your child to college? Governor Perry has proposed freezing tuition for four years of a student’s education. So, at least you would know the price you are paying as a freshman will be the same you can expect to budget for the senior year. As Perry explains, “This will help Texas families plan while giving students another incentive to finish on time.”  This change could impact your taxes, child support, and other financial matters that have a legal component.

If you are a business owner, you may be interested in learning more about the incentives that the governor has in mind for you. He wants to raise the business tax exemption to $1 million from the current $300,000 in gross receipts. This tax on gross receipts was established in 2006 and received a great deal of criticism from small business owners. In addition, the governor asked the legislature for $260 million in additional funds to further his Texas Enterprise Fund, which encourages businesses to relocate to Texas. With one of the strongest job growth rates among states in this tough economy, Texas certainly should already be appealing to employers who are looking for some sense of stability during these difficult times.

Disaster looms! Two days ago now a federal court denied a plea to delay the massive increase in rates webcasters must pay the record labels. This means that, absent immediate Congressional action, the new ruinous royalty rates will be going into effect on Monday threatening the future of all internet radio.

People can actually help stop this by calling their Congressional representatives in the Senate and asking them to force immediate action on the Internet Radio Equality Act and bring the bill to a vote. Every band dreams of the lucky night it’ll be discovered by a music promoter or favorite record label. Overnight you’ve got a hot record, radio stations everywhere playing your songs and your band becomes a household name. It’s the classic musician’s fairy tale.

But it is a fairy tale and, for every new artist who is discovered by a major record label, there are thousands who aren’t. For the rest of us, pursuing a career in music is hard. Now, proposed new royalty rates for Internet radio threaten to make it harder. The Copyright Royalty Board recently issued catastrophic royalty rate hikes — increases from 300 to 1,200 percent — which are set to take effect July 15. And some of the increases will be retroactive to January of last year.

While music artists certainly benefit from royalties, this kind of royalty rate hike will mean bankruptcy for almost every Webcaster. Music is a labor of love for many Webcasters, as it is for so many musicians. A significant number of small Internet radio stations already operate at a loss; they carry on because of their commitment to the music they play. A dramatic rate hike is more than most can bear.

Right now, independent artists make up less than 10 percent of what’s played on broadcast radio, but on Internet radio, we make up about 37 percent.

The reality is if our representatives in Congress allow these new royalty rates to go into effect — and it’s within Congress’ power to decide — it’ll make it far harder for independent artists like us to make it. Worse for those of us who are also music fans, online radio will start to sound a whole lot more like broadcast radio. Millions of people whose musical tastes aren’t served by broadcast radio will be left without an alternative.

While we’ve become believers in Internet radio for selfish reasons — as both artists and listeners — the principle of creating a marketplace encouraging artistic entrepreneurs stands on its own. It should be no surprise that the Internet, which has been the source of innovation in so many different industries, has been the home of and outlet for innovation in the music industry.

From an artists perspective, killing Internet radio means that thousands of great bands will go undiscovered — and that’s nothing but bad news for artists.

Killing Internet radio will not only stifle the great technology we have now, it will also stifle the innovation of even better, newer and more exciting ways to enjoy music — and that’s nothing but bad news for all of us.

So while you may think that Internet Radio is not going to suffer, think again. These stations that broadcast music are not making massive amounts of ad revenue to begin with. A push towards these higher royalty fees is no doubt going to hurt the amount of fresh music you will get to hear.

Texas State University

Texas State University is situated in San Marcos, Texas Till recent times, Texas State University was better known as Southwest Texas State University. Texas State University was founded in 1899 as a normal school with an idea to educate teachers. It was in 2003, that the University was finally recognized officially as Texas State University. There are bachelor degrees in criminal justice, agriculture, business administration, theatre and dance, education, music, art and design, creative writing, radiation therapy, anthropology, geography, sociology, international studies, social work, philosophy, and health administration.

Master’s degrees are also awarded in aquatic biology, accounting, creative writing, education, geography, industrial mathematics, healthcare administration, interdisciplinary studies, professional counseling, music, recreation and leisure services, theatre, social work, and wildlife ecology.

The University Awards only six highly recognized Doctoral degrees, in school improvement education, adult, professional and community education, aquatic resources, and in geography. It is a must for the unmarried students to stay in the University itself. The university has its recital hall, an auditorium, a music building, an outdoor theatre, and well equipped library. A certified course in Creative Writing is also available which is highly recognized by Associated Writing Programs. The University also offers the country’s first stuttering therapy program.

The Texas State Bird

The mockingbird is the state bird of Texas. Most States in the United States of America have a State bird associated with it. The State of Texas too has a bird associated with it. The Texas State Bird is known as the Mocking Bird. Scientifically, the mocking bird is known as the mimus polyglottos. It is about ten inches in length, including its reasonably long tail. It has a shade of light grayish coat and a whitish underside. The wings and the tail of the Texas State Bird are of a darker shade of gray with white patches on it.

If you ask any Texan, he or she will undoubtedly tell you just how beautiful the song of the bird is in comparison to any other native North American bird. Probably that is the core reason as to why the mocking bird was accepted as the Texas State Bird in 1927.

Recommended by the Texas Federation of Women’s Clubs, the mockingbird was adopted as the official bird for the state of Texas by an act of the Legislature, which was then approved on January 31st, 1927. The reason as to why the mockingbird was selected as the certified state bird for Texas was for numerous reasons. Firstly, the bird is found in all parts of Texas. Secondly, ornithologists, musicians, educators and Texans coming from all walks of life fuse together in asserting the Mockingbird to be the most appropriate specie for the state of Texas. And most importantly, the Texas Federation of Women’s Clubs named the Mockingbird as the State bird of Texas and asked the Fortieth Legislature to adopt it.

The ordinary mockingbird is a fabulous songbird and mimic. The mockingbird’s song is pleasant to the ears and is rhythmic. Sometimes it sings all night long, particularly during springtime moonlight. The mated males sing less than the unmated ones. Amazingly both the male and the female birds sing during the time of fall to call upon winter feeding territories. These locations are commonly different that their spring breeding territories.

The song of the Texas State Bird is more like a melody of the calls of various other kinds of birds; each melody is continual for several times. The mockingbird also imitates sounds that it hears from other species, pianos, sirens, barking of dogs, etc. Each replication is repeated two or three times, then another song is begun, all of this in a hasty sequence.  The Texas State Bird is also known as a ferocious guardian of its nest and environment. Many times people have seen the mockingbird to swoop down on a dog; cat or predator that may be coming too close to the bird’s protected territory, thus making it a fighter for the protection of its home, falling if need be, in its defense; like any true Texan.

Regarding a Texas state map, there are quite a few places to write about and many more that will be coming up. With several new Real Estate Developments in Dallas and Houston alone, it is hard to believe there is this so called, recession. I guess it all depends. . .

Usually when I take my road trips between Dallas and Houston I try to have as much fun as possible in the area between, making unnecessary stops and trying to meet the town’s people along the way. This is where a good Texas state map comes in handy.

I never really had the desire to go to Houston and spend any significant amount of time as my Texas state map had shown Houston as being a city with an abundance of people and not so much space to accommodate everyone. I did not have this experience when I went to visit a friend and ended up staying for almost a week. I had a lovely time!
